Plain-language note: These Terms govern use of ReachHawks, an outbound and inbound sales-engagement platform with mailbox connections, campaign sending, Unibox, built-in CRM, lead capture, newsletters, integrations and Hawk AI reply handling. ReachHawks does not guarantee deliverability, meetings, revenue or sales outcomes, and it does not provide legal advice.
1. Agreement to these Terms
These Terms of Service govern access to and use of the ReachHawks website, application, workspaces, outbound email features, inbound portal, forms, newsletters, mailbox connections, Unibox, CRM, list verification, Hawk AI, integrations, analytics, billing and related services (collectively, the “Service”). By creating an account, starting a trial, subscribing, inviting workspace users or using the Service, you agree to these Terms.
ReachHawks is a software product operated by Email Verse, LLC. References to “ReachHawks,” “we,” “us,” or “our” mean Email Verse, LLC in its capacity as operator of the ReachHawks product.
2. Eligibility and business use
ReachHawks is intended for professional, business and primarily B2B use. You must have authority to use the Service for yourself or your organization and must not use it where prohibited by applicable law.
3. Description of the Service
ReachHawks provides software for outbound campaign sending, mailbox connection and rotation, bounce and unsubscribe management, list verification where enabled, A/B sequencing, inbound lead capture, newsletters, Unibox, CRM workflows, analytics, AI-assisted reply handling, meeting booking and third-party integrations. LinkedIn outreach is available through supported third-party integrations such as SendPilot or HeyReach rather than as a native LinkedIn automation service.
Features may vary by plan, add-on, provider availability or technical configuration. List verification and certain AI usage may be priced separately. Users may connect their own supported AI API key where available or choose a ReachHawks-provided AI option subject to the applicable fee.
4. Accounts, workspaces and credentials
- You must provide accurate account information and keep it current.
- You are responsible for protecting account credentials and restricting workspace access appropriately.
- Owners and administrators are responsible for permissions assigned to workspace members.
- You must notify us promptly of suspected unauthorized access, credential compromise or abusive activity.
5. Customer Content and lead data
“Customer Content” includes contacts, email addresses, names, company data, LinkedIn URLs, form submissions, campaign copy, replies, CRM records, tags, notes, documents, website context, AI training material, imported CSV data and other information submitted or generated through your use of the Service.
You retain ownership of Customer Content. You grant ReachHawks a limited, non-exclusive license to host, process, transmit, transform and display Customer Content only as reasonably necessary to provide, secure, support and maintain the Service. You are responsible for ensuring you have the rights, permissions and lawful basis required to upload and use Customer Content.
6. Mailboxes, integrations and third-party credentials
The Service may connect to Google Workspace, Microsoft, SMTP providers, Mailgun, SendGrid, Amazon SES, Postmark, Mailjet, SparkPost, Elastic Email, Slack, HubSpot, HighLevel, Zapier, n8n, Calendly, Cal.com, supported AI providers, SendPilot, HeyReach and other third-party services. You authorize ReachHawks to exchange the data reasonably necessary to perform the integration you configure.
Third-party services remain governed by their own terms, privacy practices, limits and platform rules. ReachHawks is not responsible for third-party outages, suspensions, API changes, account restrictions or decisions outside our reasonable control.
7. Hawk AI and automated actions
Hawk AI may analyze conversation content, website information, uploaded PDF or DOCX files and workflow context to classify replies, propose responses, book meetings, tag leads, update CRM stages and organize Unibox activity. AI outputs may be inaccurate, incomplete, inappropriate or inconsistent.
Assistant Mode is designed for human-guided reply selection. Manager Mode can automate reply handling based on your configuration and training signals. You remain responsible for choosing when automation is appropriate, monitoring outcomes and complying with applicable law and third-party platform requirements.
8. Outreach compliance and user responsibility
You are solely responsible for the lawfulness of your lists, campaigns, recipients, sender identity, message content, legal basis, notices, consent where required, unsubscribe mechanisms and suppression handling. Depending on your location and target market, applicable rules may include CAN-SPAM, GDPR, UK GDPR, ePrivacy/PECR, CASL, state privacy laws and other marketing or data-protection laws.
ReachHawks provides tools that can support operational compliance, such as unsubscribe management, suppression handling and sender controls, but software functionality does not make a campaign lawful by itself.
9. CAN-SPAM-oriented requirements
For commercial email subject to CAN-SPAM, users are responsible for using accurate header and routing information, non-deceptive subject lines, required commercial-message disclosures, a valid physical postal address, a clear opt-out method and prompt honoring of opt-out requests. Users must not sell or transfer addresses of recipients who have opted out except as permitted for compliance purposes.
10. Prohibited uses
You may not use ReachHawks for unlawful, abusive or deceptive activity. Prohibited use includes:
- Spam, phishing, credential theft, impersonation, malware, scams, fraudulent offers or deceptive marketing.
- Hate speech, racist or discriminatory harassment, threats, targeted abuse or unlawful intimidation.
- Promotion, recruitment, fundraising or facilitation for terrorism or violent extremist activity.
- Trafficking, exploitation, illegal goods or services, or content that violates applicable criminal law.
- Unauthorized scraping, credential stuffing, account compromise, security bypass or interference with the Service.
- Uploading highly sensitive personal information without a lawful and necessary business reason and appropriate safeguards.
- Using the Service to violate privacy rights, intellectual-property rights, platform rules or applicable communications law.
We may suspend or terminate accounts where we reasonably believe use creates legal, security, reputational or operational risk.
11. Privacy and data-protection practices
Our Privacy Policy explains how we process information. ReachHawks follows privacy practices informed by GDPR and UK GDPR principles, including purpose limitation, data minimization, storage limitation, transparency and support for access, correction and deletion requests where applicable. We do not sell customer-uploaded data as a standalone database.
Where ReachHawks processes Customer Content on behalf of a customer, a Data Processing Addendum may supplement these Terms on request and may incorporate applicable international-transfer safeguards described in the Privacy Policy. ReachHawks does not currently claim ISO 27001, SOC 2 or EU-U.S. Data Privacy Framework certification and does not represent that every customer use case is automatically GDPR-compliant.
12. Trial, plans, billing and add-ons
ReachHawks may offer paid subscriptions, add-ons, verification credits, AI usage, additional workspaces, configuration services or management services. Pricing and limits shown on the website, app or checkout control at the time of purchase.
ReachHawks currently offers a 7-day free trial with no payment card required. The trial does not automatically create a paid charge unless you actively subscribe or purchase a paid service.
13. Cancellations and refunds
ReachHawks does not offer a general refund policy for paid subscriptions or consumed usage. The 7-day no-card trial is provided so users can evaluate the product before purchasing. After a paid charge, amounts are non-refundable except where required by applicable law, a billing error is confirmed, or we expressly agree otherwise in writing. See the Refund Policy for details.
14. Deliverability, account reputation and platform limits
Email deliverability depends on factors outside ReachHawks, including domain reputation, mailbox provider rules, recipient engagement, list quality, DNS configuration, sender behavior and third-party infrastructure. We do not guarantee inbox placement, sender reputation, reply rates or uninterrupted provider access.
15. Intellectual property
ReachHawks, its software, interface, workflows, branding, designs, documentation, templates, prompts, analytics, code and related intellectual property are owned by Email Verse, LLC or its licensors. Except as permitted by these Terms, you may not copy, resell, reverse engineer, sublicense or create derivative services from the Service.
16. Availability, modifications and beta features
We aim to provide a reliable service but do not guarantee uninterrupted availability. We may change, replace, limit, suspend or discontinue features, integrations, providers, pricing, usage limits or beta functionality for security, reliability, compliance, product or cost reasons.
17. Suspension and termination
We may suspend, restrict or terminate access for non-payment, abuse, prohibited content, legal risk, security risk, repeated complaints, excessive bounce or abuse patterns, misuse of third-party services or violations of these Terms. You may stop using the Service or cancel a subscription subject to the applicable billing terms.
18. Disclaimers
The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy and guaranteed results.
ReachHawks does not guarantee deliverability, meetings booked, lead quality, response rates, conversions, revenue, compliance outcomes or AI accuracy.
19. Limitation of liability
To the fullest extent permitted by law, ReachHawks and Email Verse, LLC will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profits, lost revenue, lost opportunities, business interruption, reputational harm, lost data or losses caused by campaigns, AI outputs, third-party providers or inability to access the Service.
To the fullest extent permitted by law, our aggregate liability for claims relating to the Service will not exceed the amount you paid for ReachHawks during the three months preceding the event giving rise to the claim, or USD $100 if no paid amount was made, unless applicable law requires otherwise.
20. Indemnification
You agree to defend, indemnify and hold harmless Email Verse, LLC, ReachHawks and their owners, officers, employees, contractors and providers from claims, losses, damages and expenses arising from your Customer Content, campaigns, recipients, use of the Service, violation of these Terms or violation of law or third-party rights.
21. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, unless mandatory applicable law requires otherwise. Courts located in Wyoming will have jurisdiction unless another forum is required by applicable law.
22. Changes to these Terms
We may update these Terms from time to time. Material changes may be communicated through the website, application, email or another reasonable channel. Continued use after updated Terms become effective constitutes acceptance to the extent permitted by law.
